Terms & conditions
These terms explain how the Torq Racewear online shop and orders placed through it work. They apply from 23 August 2026.
Torq Technical Clothing Ltd, trading as Torq Racewear, is registered in England and Wales under company number 08897832. Registered office: 89 Pilkington Avenue, Sutton Coldfield, England, B72 1LG. Email: info@torq-racewear.com.
1. About these terms
These terms apply when you use shop.torqracewear.com or place an order through it. A product page, quotation or order confirmation may contain product-specific information, specifications, prices, delivery estimates or terms. If there is a direct conflict, the order confirmation takes priority for that order, except where the law does not allow a term to be changed or excluded.
A consumer is someone buying wholly or mainly outside their trade, business, craft or profession. Provisions that refer specifically to consumers or business customers apply only in that capacity.
2. Website use
The shop provides product, sizing, availability, price and ordering information. You may use it only for lawful personal or business purposes. You must not interfere with its security, attempt unauthorised access, introduce malicious code, scrape it in a way that impairs the service, or use Torq content or branding without permission.
Torq takes reasonable care to keep shop information accurate. Product photographs, colours and screen previews are illustrative, and reasonable differences can arise from display settings, lighting, fabric, print methods and manufacturing tolerances. Torq may correct errors and update content, availability or specifications before an order is accepted.
3. Orders and contract formation
Placing an order is your offer to buy the products in your basket. You will receive an automated acknowledgement, but that acknowledgement does not by itself mean the order has been accepted. A contract is formed when Torq sends an acceptance or dispatch confirmation, or otherwise expressly confirms acceptance.
Torq may decline or cancel an order before acceptance where, for example, a product is unavailable, payment is not authorised, delivery information is incomplete, artwork cannot lawfully be used, an age or location restriction applies, or the price or description contains an obvious error. If payment has already been taken for an order Torq cannot accept, it will be refunded.
You are responsible for checking the products, quantities, sizes, personalisation, billing information, delivery address and contact details before submitting the order. Contact Torq promptly if an acknowledgement contains an error.
4. Products and availability
Products are subject to availability. An item being shown on the website does not guarantee stock until Torq accepts the order. Torq may set reasonable quantity limits or withdraw a product.
Choose sizes and product specifications carefully. Where a product includes a measurement guide, care instructions, safety information, homologation information or permitted-use details, these form part of the product information and should be reviewed before ordering and use.
5. Prices and payment
Prices are in pounds sterling. The shop identifies the product price, applicable VAT and any delivery charge before you submit the order. The final order total shown at checkout is the total payable unless the website clearly identifies a later charge that you have expressly agreed.
Payment must be made using a payment method offered at checkout. Payment-card details are handled by the relevant secure payment provider and should never be sent to Torq by email or through a general contact form. Torq may carry out reasonable anti-fraud and payment-authorisation checks.
If an obvious pricing error could reasonably have been recognised as an error, Torq does not have to supply the product at the incorrect price. Torq will contact you and offer the choice of paying the correct price or cancelling for a full refund.
6. Dispatch and delivery
Stocked items are dispatched within 24 hours after purchase. Dispatch is the point at which the parcel leaves Torq; it is separate from the carrier’s delivery time. Available delivery methods, charges and estimates are shown at checkout.
Customised, personalised, made-to-order or temporarily unavailable products can have a different lead time. That lead time will be stated on the product page, at checkout, or agreed with you before the order is accepted.
Unless another time has been agreed, consumer orders will be delivered without undue delay and no later than 30 days after the contract is formed. If Torq becomes aware of a material delay, it will contact you. Consumer rights concerning late or failed delivery remain unaffected.
Risk in a consumer order passes when the goods are delivered to you or to a person you identified to receive them. For a business customer, risk passes as stated in the order confirmation or, if it says nothing, on delivery to the nominated address.
7. Consumer cancellation rights
For most standard, non-personalised goods bought online, a consumer may cancel without giving a reason from the time the order is placed until 14 days after the goods are received. To cancel, send a clear statement to info@torq-racewear.com before the cancellation period ends. You may use the model cancellation form on the Delivery & Returns page, but you do not have to.
After notifying Torq, return the goods within 14 days. Keep them safe and handle them only as you would in a shop to establish their nature, characteristics and function. A refund may be reduced for loss in value caused by handling beyond that.
Torq covers return postage. Contact Torq before sending anything so it can arrange a prepaid method or confirm how reasonable standard return-postage costs will be reimbursed and where the parcel must be sent.
Where the cancellation right applies, Torq will refund the product price and the cost of the least expensive standard outbound delivery offered. Any extra amount paid for premium delivery does not have to be refunded. Refund timing and method are described on the Delivery & Returns page.
8. Personalised goods and other cancellation exceptions
The statutory change-of-mind cancellation right does not normally apply to goods made to your specification or clearly personalised. This can include products printed, embroidered, altered or otherwise made for you after the order is placed. Torq will identify custom options where practical before purchase.
The cancellation right can also be lost for sealed goods that are not suitable for return for health-protection or hygiene reasons after the seal is broken. This exception is applied only where the law permits it.
These exceptions do not affect your rights where an item is faulty, not as described, not fit for purpose or not made in accordance with the agreed specification.
9. Returns, refunds and product problems
Read the Delivery & Returns page for the practical return process. Do not post an item without first contacting Torq for instructions and the correct return destination.
Inspect your order as soon as reasonably possible. If a product is damaged, faulty, incorrect or not as described, email info@torq-racewear.com with the order number and a clear description; photographs may help Torq assess the issue. Do not continue using a product if that could worsen the issue or create a safety concern.
Where goods do not conform to the contract, Torq will provide the remedy required by law. Depending on the circumstances, that may include repair, replacement, a price reduction or refund. Torq also covers the return postage for the process it agrees with you.
10. Designs, artwork, measurements and custom products
If Torq supplies a design draft or proof, you must check all wording, spelling, numbers, colours, logo placement, sizes and other details before approval. Production may begin after approval, and later changes may be impossible or chargeable.
You confirm that you own, or have permission to reproduce, every logo, name, image, trade mark, copyright work and other material you supply or ask Torq to use. Torq may ask for evidence, refuse material that may infringe another person’s rights, or pause the order while permission is checked.
Measurements supplied by you, or someone acting for you, are treated as accurate. Follow Torq’s current measurement guidance and ask before approving an uncertain measurement. This does not affect your rights if Torq makes the product incorrectly or the product is otherwise faulty or not as described.
11. Product use and safety
Use, store, clean and maintain products in accordance with their labels, supplied instructions, homologation and the rules of the relevant championship, venue or governing body. You are responsible for checking that the selected product and approval are suitable and current for your intended event. Motorsport is inherently dangerous, and no garment can remove all risk.
Do not alter safety-critical construction, remove required labels or continue to use damaged protective clothing. Contact Torq if you need product or approval information before use.
12. Intellectual property
The website, Torq name and logos, photographs, templates, graphics, copy and Torq-created design work are protected by intellectual-property rights. Unless expressly agreed in writing, Torq retains those rights. Buying a product does not transfer ownership of an underlying template, artwork or manufacturing file.
You may not reproduce, sell, distribute or provide Torq templates or production-ready design files to another manufacturer without written permission.
13. Responsibility and liability
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of rights that cannot legally be excluded, or any other liability that the law does not permit Torq to exclude.
Torq is responsible for foreseeable loss caused by its breach of these terms or failure to use reasonable care and skill. It is not responsible for loss that was not foreseeable, was caused by inaccurate information or unauthorised artwork supplied by you, or could reasonably have been avoided by following Torq’s instructions.
For business customers only, Torq is not liable for indirect or consequential loss, loss of profit, revenue, business, anticipated savings or goodwill. Subject to liabilities that cannot be limited, Torq’s total liability to a business customer arising from an order will not exceed the total price paid or payable for that order. This business-customer limitation does not restrict consumer statutory rights.
14. Events outside reasonable control
Torq is not responsible for delay or failure caused by events outside its reasonable control, such as carrier disruption, material shortages, manufacturing interruption, industrial action, natural events, war, public-health restrictions or failure of essential utilities. Torq will take reasonable steps to reduce the effect and resume performance when possible. Any statutory right to end the contract because of a serious delay remains unaffected.
15. Privacy
Torq uses personal information to administer accounts, process payments, fulfil and support orders, meet legal obligations, prevent fraud and operate the shop. See the shop’s Privacy Policy and cookie controls for more information. Payment providers, carriers and other service providers receive information only where needed for their role.
16. General terms
Torq may transfer its rights and obligations under a contract to another organisation, but this will not reduce a consumer’s rights. You may transfer your rights only with Torq’s written agreement, except where the law gives you a right to do so.
If a court finds part of these terms unlawful, the remaining terms continue. A delay in enforcing a right does not waive it. No person other than you and Torq has a right to enforce the contract, except a permitted successor or transferee.
17. Governing law, complaints and contact
These terms and each contract are governed by the law of England and Wales. The courts of England and Wales have jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the part of the UK where you live and retain any mandatory local protections.
